Commission Terms and Conditions

1. GENERAL TERMS

Hello there! As your creative assistant, I want to let you know that I cannot create any pieces that involve plagiarism of another artist's Artwork, hate speech, homophobia, racism, extreme gore and violence, animals, mecha/anime, or sexual acts. Please keep in mind that all artworks will be created in the Artist's unique and creative style. Thank you for understanding!

2. COPYRIGHT/ USAGE POLICY

• As the creator, Jasmine Wooten (The Artist), I retain the rights to the Artwork produced and not the Buyer. This means I have permission to use the copyrighted Artwork for promotional purposes on my website, social media, publications, and in-person events as I see fit.
• Every painting will feature a signature mark that cannot be removed.
• Please note that all artworks are intended for personal use only.
• Unless otherwise agreed upon, I possess the rights to the image and its use/distribution. However, you may purchase the rights to use the image for your own non-personal use at any time.

The Buyer is ALLOWED to:

• The Buyer can only use the commissioned piece for personal purposes. Artwork images can be uploaded on social media profiles, forums, and similar platforms, but please credit me as the Artist. 

The following is considered Copyright Infringement:

• Using or reproducing copyrighted Artwork for commercial purposes without the Artist's express written permission is prohibited and may result in monetization consequences.
• Taking credit for my Artwork.
• Removing my signature from the Artwork.
• Altering the Artwork without my consent.

3. PAYMENT:

• You can pay in $USD using Paypal, Square, or Cashapp service.
• The price of a painting or work varies based on factors like size, subject, materials used, time, taxes, etc., The starting price for a painting or work is $300.00, which can increase depending on the commission's specific requirements.
• A 50% deposit is required upon accepting the collaboration to secure your spot and cover the time worked and supplies. The remaining balance should be settled before delivery or shipping upon completion.
• To complete the process, kindly send the Artist a screenshot or receipt as a confirmation of payment.
• In the event that you engage in fraudulent activity and attempt to open a chargeback case through your bank or any third-party payment service, I will have to decline the chargeback. In addition to this, I will provide the bank or third-party payment service with evidence of our agreement for the requested work. It's important to note that if such a situation occurs, you will be blacklisted from ever commissioning me again and subsequently blocked.

4. PROCESS AND DELIVERY:

• To assist me in my artistic process, the client needs to provide reference photos and detailed descriptions, including size and any other specifics of the pieces they want me to create.
• Once a request is submitted, it will be evaluated based on timing and relevance to our vision. If your commission is selected, we will proceed accordingly.
• I reserve the right to refuse any request for a commission for any reason.
• The time it takes to complete a commissioned piece is typically 3-5 weeks before it can be shipped.
• I will inform customers about the commissioned pieces' progress as they are being created and allow you to provide feedback to ensure the work aligns with the Buyer's vision.
• While creating the piece, I will only accept a maximum of two reasonable revisions.
• The completion of the Artwork may be delayed due to the Artist's schedule and personal matters such as work or family obligations. Rest assured that you will receive notice of any delays, and the piece will still be completed as promised. 

• **NO CANCELLATIONS or REFUNDS shall be accepted**

• In the event that the Buyer violates any of the conditions mentioned above, they will forfeit all rights to the commissioned Artwork created by Jasmine Wooten (The Artist). In such a case, I (the Artist) reserve the right to use the Artwork for any other profits I deem fit. If you have any concerns regarding the conditions above, please discuss them with me before paying for the commissioned Artwork.
